A BILL to amend article two, chapter five-a of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section nineteen-a, relating to special reports by spending units; requiring reports to be filed with the secretary of administration within thirty days of the end of each fiscal year; providing that reports detail anticipated and potential matters which may have a substantial and material impact on future spending obligations in subsequent fiscal years; and authorizing the secretary of administration to prescribe forms and propose rules for implementing these requirements.

Be it enacted by the Legislature of West Virginia:
That article two, chapter five-a of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section nineteen-a, to read as follows:
ARTICLE 2. FINANCE DIVISION.

§5A-2-19a. Special reports by spending units; notification of pending matters having impact on future expenditure requirements.

(a) Every agency of state government shall, within thirty days following the end of each fiscal year, submit to the secretary of administration a detailed report and accounting of all pending actions which may likely have a substantial and material impact on future spending obligation in subsequent fiscal years. This reporting requirement shall include all pending legal actions, unresolved audit findings and any other actions or matters which may have a substantial and material impact on future expenditure requirements and obligations by the state.
(b) All reports required under the provisions of this section shall be on those forms prescribed by the secretary of administration for this purpose. Upon receipt thereof, the secretary shall immediately send copies of all the reports to the legislative auditor.
(c) The secretary of administration shall propose administrative rules, in accordance with the provisions of article three-a, chapter twenty-nine-a of this code, that may be required for the proper implementation of this section. These rules shall, among other things, provide proper definition to those pending actions and matters which are considered to be reportable under the provisions of this section.


NOTE: The purpose of this bill is to provide for special reporting requirements for agencies of state government to disclose anticipated or future expenditures or obligations within thirty days of the end of each fiscal year.
